Brian Gerard O’Toole (61), of Rue de Maistre, St Mary, left the pub just after 9 pm on 15 December and drove onto Rue des Buttes, where he was stopped in an honorary police road check.

The Magistrate’s Court heard that O’Toole told officers he had consumed a pint of beer at about 7 pm but he failed a roadside breath test. When he gave a sample at the States police’s headquarters the reading was 43 mcg of alcohol in 100 ml of blood. The legal limit is 35 mcg.

He also admitted still using his Irish driving licence. Advocate Jeremy Orchard, defending, said that O’Toole came back to Jersey in August to get a job in construction and was not aware he had to change his licence immediately.

‘He was under the mistaken belief that there was a lead-in period before he had to transfer his licence to a Jersey one.

‘He had the application form at home and had intended to fill it in,’ said Advocate Orchard.

In sentencing, Magistrate Bridget Shaw said: ‘I am taking into account that you have never been in trouble before and that you pleaded guilty on the first occasion.’
