A GYM receptionist who worked for more than a month without receiving a contract, wages or payslips has been awarded almost £2,200.
The Employment and Discrimination Tribunal ordered One Motivation Limited to pay former employee Liedson Pestana £2,193.19 following a hearing earlier this month.
Mr Pestana said he agreed to work for the company under a zero-hours arrangement carrying a minimum of 16.5 hours per week.
He worked 68.5 hours at the Halkett Street-based fitness centre between 5 March and 9 April, earning £14 per hour during March and £15 per hour from April.
Mr Pestana repeatedly chased the company after neither his contract nor wages arrived. The tribunal found that promises were made “at various times”, but were not kept.
One Motivation did not respond to the claim, apply for an extension or attend the hearing.
Deputy tribunal chair Advocate Cyril Whelan accepted Mr Pestana’s evidence and said the business had acted “as though the statutory requirements did not exist”.
The gym company was ordered to pay £980 in unpaid wages, £69.85 in holiday pay and £1,143.34 for failing to provide written terms and payslips.
Advocate Whelan added that One Motivation could not use its failure to pay Mr Pestana as a reason for also failing to issue payslips.
However, Mr Pestana’s claim for automatic unfair dismissal was rejected because there was no evidence that his employment ended for a reason protected by law.
