A MAN has been sentenced to 120 hours of community service for sexually touching another man without his consent.

Jose Marcio Oliveira Lucas (46) admitted the offence after police officers tracked him down using only his physical description.

Legal adviser Harrison Gollop, prosecuting, told the Magistrate’s Court that the victim had been walking when Oliveira Lucas whistled at him.

The victim had initially thought Oliveira Lucas had mistaken him with somebody else, the court heard.

Oliveira Lucas then asked him if he wanted to go for a smoke, which the victim declined.

He then grabbed the victim’s penis over his trousers.

The victim resisted and tried to follow him as he ran off, but when he couldn’t follow, police officers searched the area and found Oliveira Lucas at his home, where they arrested him.

The incident had “a profound effect” on the victim, Mr Gollop said.

Advocate Rui Tremoceiro, defending, said that Oliveira Lucas had pleaded guilty at the first opportunity and that the probation service had recommended community service as “a constructive way of dealing with the matter”.

He had a number of positive references, the court was told.

Assistant Magistrate Adam Clarke told Oliveira Lucas: “This was a selfish and unwarranted act.”

Oliveira Lucas was given 120 hours of community service and a six-month probation order.
