The Health Protection Department have taken the unusual step of serving a statutory notice order on the minister, calling on the Transport and Technical Services department to show that they are using the most effective measures to counteract the effects of the nuisance.
The department were seeking legal advice on the situation at La Collette when they also received a letter from the Constable of St Helier, Simon Crowcroft, putting forward a case that they should use the statutory nuisance legislation in relation to that site.
If Transport and Technical Services fail to take all steps to meet best practice at the site, the Transport Minister could be prosecuted, Health Protection have said.
Deputy de Faye told the JEP that he was ‘utterly astonished’ to be served with the notice about La Collette when the smell emanating from the Bellozanne sewage plant which is far closer to residents ‘was much worse’.
