Bailiff’s dual role defended

This week the States are due to debate whether the Bailiff should be allowed to continue to both chair States sittings and preside over legal cases in the Royal Court.

The dual role has long attracted criticism for being a ‘conflict of interest’ as the Bailiff acts in both the law-making States Assembly and also interprets laws in Jersey’s courts.

Critics have said that this breaches Article Six of the European Convention on Human Rights – the right to a fair trial – as the Bailiff could be seen as non-independent.
