A MAN who refused to give police access to his phone – even after a formal notice was issued – has been given a community service order.
Sebastian Arkadiusz Dabrowski (29) appeared in the Magistrate’s Court on Friday morning.
Legal adviser Samantha Morris described how at a police interview, Dubrowski refused to give police officers his PIN as he did not want to reveal messages, and he continued to refuse after he was issued a notice.
Officers accessed his phone via “brute force”, which limits the information they can access, Ms Morris said.
Advocate Allana Binnie, defending, cited several references and a “very sincere and reflective letter of remorse”. Dubrowski had previous good character and would welcome a probation order, she said.
Magistrate Sarah Fitz told Dubrowski it was “a serious offence”, but that owing to his honesty with officers and his low to moderate risk of reoffending, he would avoid custody.
She sentenced him to a nine-month probation order and 50 hours of community service.
