A 39-YEAR-OLD man who defecated on a park bench in full view of other people has been fined £100.

Alex John Nicholas committed the act in Parade Gardens at 11am on Sunday morning, the Magistrate’s Court heard yesterday.

Legal adviser Harrison Gollop, prosecuting, said Nicholas had a string of previous convictions and was already subject

to a six-month binding-over order, imposed on 7 June, for being drunk and incapable.

He served a week in prison for contempt of court after turning up drunk to his June court hearing.

Nicholas admitted the charge of behaviour likely to cause annoyance. Advocate Chris Baglin, defending, said: ‘He is terribly sorry. He was fully co-operative and admitted what he had done.

‘He is on medication for his stomach – he hadn’t taken his tablets and the toilets were closed.

‘It’s one thing being caught short, but there are still less-public places.’

Assistant Magistrate Sarah Fitz told Nicholas: ‘People should be entitled to use the park without this sort of unpleasant incident.’

As well as the fine, she ordered that the binding-over order should continue.
