Koh Tao murders: Appeal looks at forensic evidence

Convicted murderers Zaw Lin and Wai Phyo insist they are not guilty of killing former Victoria College student David Miller (24) and Hannah Witheridge (23) from Norfolk on the Thai island of Koh Tao in September 2014.

The pair, who met on the Island, were beaten to death with a garden hoe. A post-mortem examination found that Miss Witheridge had also been raped.

Zaw Lin and Wai Phyo, who are both from Burma, were found guilty of rape and murder in December 2015 and sentenced to death.

An earlier appeal was rejected in March and they have now lodged their latest and last appeal with the Thai Supreme court.

Nakhon Chompuchat, head of the defence team which has represented the men throughout, said they are arguing the reliability of forensic procedures and suggest police failed to properly collect DNA samples which led to the convictions.

The DNA of Zaw Lin and Wai Phyo was found to match samples found on the body of Miss Witheridge.

The defence team want the DNA samples to be re-examined but, according to reports, Lieutenant Colonel Somsak, who led the original police investigation, has said the samples no longer exist. He also says that a hair sample found in Miss Witheridge’s hand was among samples that were lost.

Mr Miller’s family insist they believe justice has been served but have openly stated they are against the death penalty.
