Nacer Benyoussef (33) has spent the equivalent of a six-month sentence behind bars after a jury found him guilty of attacking a young woman and trying to rip off her trousers as she lay stunned on the ground.

However, the Court of Appeal has reversed this.

Mr Benyoussef has been released from prison, and will not face a retrial for the offences, for which he was originally jailed for two years.

The victim – who the court said was not at fault for Mr Benyoussef’s wrongful conviction – was so traumatised by the attack on 26 April last year that she left Jersey to go and live abroad.

The Court of Appeal found that the Bailiff, Sir Philip Bailhache, failed to give proper instructions to the jury as to Mr Benyoussef’s character, and the likelihood of him attacking a woman.
