He has been issued with an enforcement notice by the Data Protection Registrar but will not face further prosecution.

But he is facing a Town Hall inquiry into driving while using a mobile phone and not wearing a seatbelt – on the eve of the censure debate.

Senator Vibert included e-mails in the censure motion which were sent by Senator Walker to the Planning department in which he spoke of his friend Charles Gallichan’s financial difficulties and emotional distress.

Mr Gallichan, Senator Walker and Senator Philip Ozouf, the Environment president, instituted complaints against the Senator.

Data Protection Registrar Emma Martins says Senator Vibert twice breached the law because he is only registered to use data for electoral purposes.

Mrs Martins says the issue has highlighted the confusion among States Members over what they can and cannot do.

Housing president Deputy Terry Le Main has twice breached the law and had to fight off a no-confidence motion as a result of the last offence.
