Health urged to check on care agencies over the well-being of staff

Lucy Carruthers, who suffers from scoliosis – a curvature of the spine – resigned from her job in September last year claiming that her manager ‘had no consideration’ for her health.

She cited constructive dismissal and was awarded £2,250 by the Jersey Employment Tribunal.

The tribunal found that her employer, Orchid Care Services – an approved States of Jersey care provider – had failed to provide the necessary equipment to enable her to properly look after her patient and failed to manage her condition properly.

The tribunal said that the company had taken an ‘unreasonable and deliberate’ decision and had placed her at increased risk of injury.
