Finance hub report can remain secret

In the first appeal of its kind under the Freedom of Information Law, Commissioner Emma Martins has concluded that the Treasury Department was justified in its decision not to disclose the King Sturge / Currie and Brown / Trowers & Hamlin report following a request.

She ruled that the department was justified in four of the five exemptions it cited for not making the report public and those exemptions covered information supplied in confidence, prejudice to commercial interests, prejudice to the economy and prejudice to the formulation and development of government policy.

However, she ruled that the department had incorrectly applied an exemption covering ‘vexatious requests’.
