Manuel Aguilar (24) was accused of raping the woman in her home after she returned drunk from a night out.
The woman claimed that she woke up naked in her bed in a ‘disorientated, nauseous and confused’ state – adding that she had a ‘gut feeling’ she may have been raped.
She told the jury that she performed two pregnancy tests weeks after, with both testing positive. It was then she went to the police. DNA from the terminated embryo was linked to the defendant.
Mr Aguilar always denied the allegation and was cleared by a majority verdict after about five hours’ deliberation.
