Gerald Byron Williams (47), who runs the Caribbean Vibz Restaurant at Havre des Pas, was seen by a police officer holding the phone in Gloucester Street while driving a Toyota Corolla at about 7.50 am on 15 August.
Police followed the car driven by Williams, who lives in Georgetown Road, St Saviour, through the Underpass and the vehicle was stopped at Liberation Square.
Williams told the officer he knew he should not have been using the black smartphone but denied taking both hands off the steering wheel at any point.
Centenier Philip Coffey said that the delay in the case being brought to court was because Williams failed to attend three parish hall inquiries in September and October.
He was consequently told to attend court in November and failed to appear then, so his arrest was ordered. He also faced three parking charges. He asked for leniency with one of the parking tickets, as he was transporting items for a charity event.
As a result, the fine for that ticket was £50 rather than the £70 penalty he was given for the other two tickets.
