A GYM has been ordered to pay a former employee more than £6,200 after failing to pay wages and holiday pay or provide a contract and payslips.
The Employment and Discrimination Tribunal upheld a total of four claims brought by the employee of One Motivation Limited, which did not respond to the proceedings.
Ethan Biggs began selling gym memberships on 1 February after agreeing to work 37.5 hours a week for £17 an hour, plus commission.
He worked 104 hours in February but received £1,256.78, leaving £587.14 outstanding, including commission.
Mr Biggs was not paid for 97 hours worked in March and was awarded a further £1,649, as well as £205.02 in holiday pay.
The tribunal heard that he was never given written employment terms.
About a month after starting, he received a “demo contract” which he was told not to sign. It was for zero hours, which did not reflect the original agreement, and no final contract was provided despite repeated requests.
Tribunal chair Advocate Dr Elena Moran described the failure to provide written terms as a “flagrant breach” and awarded Mr Biggs £1,912.50.
He received the same sum because the company had failed to provide a payslip for his February wages.
However, his unfair dismissal claim was rejected because he had not worked for the gym long enough and could not show that his dismissal was automatically unfair.
One Motivation must pay Mr Biggs £6,266.16 in total.
