Firm admits safety violation after gardener fell 80 ft down a cliff

Nunes Gardening and Maintenance was charged with one offence in relation to the accident which happened last May.

Company director Jose Marcelino Marote Nunes appeared in the Royal Court on Friday to answer the charge, and was represented by Advocate George Pearce.

He entered a guilty plea to the charge of failing to ensure the safety of workers by doing an adequate risk assessment of the cliffside property where the work was to be carried out and failing to provide adequate instruction and training to ensure the safety of workers.

As a result of these failings, a gardener working for the company fell from the perimeter of the north-coast property, on 16 May, and was badly injured.

Deputy Bailiff Tim Le Cocq set a sentencing date of 8 February.
