Speeder who drove at 61 mph in 20 mph zone banned for two years

Marco Andre Marante Nogueira (22), of Windsor Court, Windsor Road, also admitted hitting another man who had been dancing with his estranged girlfriend in the Havana nightclub, in Bath Street, on 11 March.

He has been put on probation for nine months and ordered to pay £500 compensation to the victim.

Police legal adviser Susie Sharpe said that Nogueira was caught by a speed check which was being carried out on the eastbound carriageway of the road into St Aubin at just after midnight on 23 November.

‘[The police officer’s] attention was drawn to the car as she could hear the roaring of its engine before it came into the police officer’s vision,’ she said.

‘It sounded like it was accelerating and he was clocked driving at 61 mph in a 20 mph zone.’

She added that the defendant’s driving put the three passengers travelling with him at risk.

‘His speed would have increased his stopping distance by five times compared to what it would have been if he had been travelling at 20 mph,’ she said.

‘He would have needed over 100m to brake as the road was damp after recent rainfall. The defendant was talking to the passengers and that would have distracted him further.’

The court heard that the assault in the Havana Club happened while Nogueira was on bail for the driving offence.

Miss Sharpe said that the victim recalled receiving a sudden blow to his head. ‘It caused his ear to start ringing and his eyes to start watering,’ she said.

The victim suffered bruising to the nose and his eye. He went to Accident and Emergency because he was was suffering blurred vision after the attack.

Advocate Holly Brown, defending, said that in respect of the dangerous driving, it was a single incident of poor driving over a short distance and the defendant had been co-operative with the police.

With regard to the assault, she said that he very much regretted his actions and submitted that it was a ‘spur of the moment’ attack.

Advocate Brown added that Nogueira had turned his life around in recent months, had been working as a painter and decorator and was considered a reliable employee.

Relief Magistrate Nuno Santos-Costa said that these were extremely serious charges and the defendant was fortunate not to be facing a term of custody.
