Two-year driving ban for man twice over limit

Shane Toal (39), of Route de la Haule, who has previously served time in custody in the UK for drink-driving, was also given 70 hours of community service and fined £200.

St Lawrence Centenier Gregory Guida said that a black Honda Civic was spotted without its lights on near the Grand Hotel heading west at about 10.20 pm on Thursday 10 August.

When the car was stopped at a car park at Bel Royal, it was found to have its lights on. However, as Toal smelt of intoxicants, a roadside breath test was conducted and he was subsequently arrested.

The breathalyser reading at police headquarters was 73 mcg of alcohol in 100 ml of breath, which is more than twice the legal drink-drive limit of 35 mcg.

Advocate Natalie Addis, defending, said that Toal arrived in Jersey in May last year and was celebrating securing a new job on the night that he was stopped.

She said that he ‘foolishly’ agreed to give his girlfriend a lift home from the pub.

Advocate Addis said that if the defendant was jailed he would lose his job and he would have to leave the Island.

In sentencing, Relief Magistrate David Le Cornu said: ‘This is his second offence of driving under the influence of alcohol in a very short period, albeit not in Jersey.’
