The matter was highlighted last week in a UK court challenge that was rejected by the Court of Appeal. The case was brought by South African resident Annette Carson (61) who claimed the UK government was unlawfully discriminating against retired Britons living abroad by refusing to increase their state pensions in line with inflation. This rule applies to all those on UK pensions living in South Africa, Australia, Canada and New Zealand, who have their pensions frozen.Jersey’s controller of Employment and Social Security, Ann Esterson, said anyone on a Jersey States pension would continue to have that pension uprated, wherever they were residing.Anyone on a UK pension who comes to live in the Island is also entitled to have their pension uprated, because of a reciprocal arrangement between Jersey and the UK, said Mrs Esterson.
