A 24-YEAR-OLD man who head-butted his father during an argument has been spared jail.
The Magistrate’s Court heard that Samuel Paul Smith’s assault on his father, which left him with a cut on his nose, on 13 December was the fourth time he had attacked his parents.
Advocate Katie Ridley, prosecuting, said Smith was under a probation order for a previous assault when he committed the latest one.
She said the father dialled 999 following the attack and locked Smith out of the house. When the police arrived they found Smith banging on the door.
Advocate Ridley added that Smith first denied the offence when interviewed by the police.
Advocate Chris Baglin, defending, said: “Mr Smith does express remorse for what he has put his mother and father through again.”
Relief Magistrate David Cadin said the offence did “cross the custodial threshold” but decided to revoke the previous probation order and impose a new, one-year order.
He told Smith: “I am prepared to give you a chance to improve your behaviour.”
