Woman ‘raped’ after night out, court told

The alleged victim, who is in her 20s, took to the stand during the first day of an Assize trial of Maricio Patricio Figueira Dias (37) at the Royal Court.

Mr Dias denies one count of rape, one count of indecent assault and three counts of attempting to pervert the course of justice.

Outlining the case, Crown Advocate Howard Sharp told the jury that the case was ‘all about consent’.

‘This is about what happens when a woman says no and this is also about what happens when a man carries on anyway,’ he said.

It is agreed that Mr Dias met the woman and her friends while they were on their way home from separate nightclubs.

The defendant and the alleged victim and her friends were not known to each other.

The woman, her friends and Mr Dias then went to a property in St Helier.

She told the court she was upstairs and noticed Mr Dias was there too. When she tried to leave she told the court he said: ‘Where are you going baby?’.

The woman claims she was then raped at the top of the stairs.
