Review your pension schemes, firms warned

Although the regulations include exemptions relating to the administration of pension schemes, lawyers at Mourant Ozannes are warning employers to give ‘careful consideration’ to the way that age is applied.

They say that trustees may also be caught out by a general provision in the law in terms of ‘aiding’ a breach of the regulations.

However, the firm says that Jersey regulations are ‘much wider’ than the UK when it comes to occupational and group pensions and that potentially discriminatory terms may be permitted under Jersey law.

The Island already has an overarching Discrimination Law and regulations applying to race and sex discrimination and the age discrimination regulations will be followed in due course by those relating to disability.
