Islander stamped on man’s head – then wrapped it in a tea towel

A MAN who stamped on another man’s head and punched him – and then gave him assistance – has been given 120 hours of community service.

The Magistrate’s Court was shown footage of the attack, filmed by a neighbour, in which David James Barry (55) stamped on the victim’s head just outside a St Helier off-licence.

The court heard that Barry later came out of the shop with a tea towel and wrapped it round the victim’s head.

Advocate Jordan Gollop, prosecuting, said the shop, Lilly’s Mini Market in La Motte Street, belonged to Barry’s wife.

Late on the evening of 6 August a customer had entered and the advocate said: ‘The customer was highly intoxicated and he was asked to leave.

‘He refused and said: “I’m going to kill your missus.”’

Advocate Julia-Anne Dix said Barry had therefore been provoked but said: ‘He accepts that provocation did not justify his actions.

‘He is not a violent man. He just snapped.’

She added that Barry had fetched the tea towel to help the man and had also pleaded guilty to grave and criminal assault at the earliest opportunity.

Barry was assessed as at medium risk of reconviction.

The court heard that Barry had been wearing soft shoes so the injuries were not severe.

Assistant Magistrate Peter Harris told him: ‘You’re lucky. For a more serious injury you would be going to prison.’

As well as the community service order he imposed a nine-month probation order and warned: ‘Make sure you keep out of trouble.’
