Man who flipped car spared jail

Alejandro Hurricane Hamon appeared in the Magistrate’s Court and pleaded guilty to driving while nearly double the drink-drive limit and possessing just over three grams of MDMA.

Centenier Danny Scaife, prosecuting, said that Hamon, who was born in Malaga, had been driving westbound along the road towards First Tower at 11.05pm on 3 August when, while passing the Lotus House takeaway, he hit a parked black Nissan.

The defendant’s Audi A1 then turned over in the air before coming to rest on its roof while the Nissan – which had a man inside who suffered minor injuries – was pushed back around 15 metres.

The emergency services were called and Hamon was checked over by paramedics and found to be uninjured.

However, he failed a roadside breathalyser test and a bag of MDMA was found in his wallet. He was arrested and taken to the States police headquarters.

At the station, another bag of MDMA was found and the defendant provided a reading of 69mg of alcohol within 100ml of breath. The legal limit is 35mg.

Advocate Luke Sette, defending, asked the Magistrate, Bridget Shaw, to impose a term of community service, adding that his client had recognised his wrongdoing.

‘We are dealing with a young man who is at a low risk of reoffending who has positive social attitudes, hobbies and good character references,’ he said. ‘He made a very bad decision to get into his car and he was not pleased about doing so. There were no taxis available and he made a decision that he will regret for the rest of his life.

‘The severity of his actions are not lost on him and he is very thankful that no one was significantly hurt.’

He added that Hamon still had five years of payments left to make on his car, which had been written off.

In handing down the court’s sentence, Mrs Shaw said that there were enough mitigating circumstances to spare Hamon prison. ‘I do not think I need to say how foolish this was and I think you appreciate that, from reading your letter [to the court].’

She added: ‘It is very fortunate that the gentleman in the Nissan only suffered minor injuries, but there was a serious collision and there has been an unacceptable level of dangerous driving.’

Hamon was ordered to complete 110 hours of community service and was banned from driving for two years. Mrs Shaw ordered that the drugs found in his possession be destroyed.
