Teenager fled barefoot from ‘rapist’s’ flat, court is told

Derek David Allen, of St Helier, denies raping and indecently assaulting the girl, who cannot be named for legal reasons.

The girl was recorded on a police officer’s body camera as she arrived at police headquarters just after 4 am, crying, without shoes and wearing her trousers inside out after running from the flat.

Outlining the prosecution case for a jury of nine men and three women, Crown Advocate Matthew Maletroit told the court that the girl had gone to the defendant’s flat after he had invited her over for a drinking ‘challenge’.

The defendant told the girl he had a ‘two-hour head start on the drinking but had not touched the Jägermeister yet’, he said.

Mr Allen admits that he had several drinks with the underage girl and also smoked cannabis resin with her, the Crown Advocate said.

The alleged victim said she was intoxicated to the point that she felt sick from the amount of rum, vodka and other drinks the two consumed, so only had a little of the cannabis. She told police that Mr Allen kissed her and, at first, she kissed him back. But then he allegedly put his hand in her jeans and assaulted her while she repeatedly told him ‘no’.

‘It was not consensual touching,’ Crown Advocate Maletroit said. ‘She repeatedly told him “no” but he was all over her and took no notice of what she was saying.’

The jury were shown videos from the policeman’s body camera and a later interview recorded for the purposes of giving her evidence, which the complainant made at the Sexual Assault Referral Centre at Dewberry House.

She told the interviewers that she could not move and while she said ‘no’, Mr Allen just carried on like he had not heard her. ‘I just turned and stared at his wardrobe,’ she said. ‘I tried not to think.

‘He eventually got off me. I just freaked. I got dressed and tried to run out but the door was locked. I couldn’t unlock it.’

The girl said she felt scared and was not sure ‘what he was capable of’. Once the door was unlocked, the alleged victim left the apartment and ran straight to the police. ‘I did not realise I had no shoes on until I was stood outside,’ she said. ‘It was really cold.’

Mr Allen was arrested at his flat about an hour later. He told the police that he could not really remember what had happened and later gave ‘no comment’ interviews.

The trial before Deputy Bailiff Tim Le Cocq continues. It is expected to last four days.
