Millionaire divorcee must pay husband’s legal fees

The woman – who is known only as S in court papers – also had her claim to reduce the amount of monthly spousal maintenance she pays to her husband dismissed.

However, an application by the husband – who is referred to as T in a judgment from the Family Division of the Royal Court – for an interim lump sum of £1.65 million to enable him to buy a home was dismissed.

According to a recently published judgment, the couple separated several years ago after more than 20 years of marriage and a decree nisi – the first court order of a divorce case – was granted in April 2017.

The family wealth derives mainly from a business which S developed and which was sold several years ago for £22.8 million. Due to the sale of the company, S lost her employment status and therefore her ability to live in the former matrimonial home in Jersey, which is up for sale.

S estimates her net wealth at just over £20 million while T claims that it is just over £24 million. He also estimates his own assets are £779,000.

In a recently published judgment T applied for a costs allowance of £200,000 in terms of his legal fees up to and including the end of the final hearing.

The court ordered that S pay T’s legal advisors a cost allowance of £100,000.

S had asked for the spousal maintenance to be reduced to £4,000 per month to reflect the fact T is now earning £1,570 a month. The court dismissed this application.

Commissioner Julian Clyde-Smith and Jurats Charles Blampied and Sally Sparrow were sitting.
