£1,000 fine for driver (79) who caused serious injury

First-time offender Margaret Gene Le Cornu, of Petite Route des Mielles, St Brelade, pulled out in front of the vehicle on Route des Quennevais on the morning of 24 November last year.

The other driver suffered a fractured sternum and spent five days in hospital. She has since made a full recovery, the Magistrate’s Court heard.

Le Cornu admitted a charge of causing serious injury by careless driving, and as well as being fined was banned from the road for one month.

Centenier Amanda Wright said that the crash took place in wet conditions at the first junction past the Airport garages. Le Cornu told police: ‘I was turning right and I thought I could make it.’ However, she pulled into the path of the other driver.

Advocate Mark Boothman, defending, said his client made a ‘simple misjudgment’. He told the court that Le Cornu accepted responsibility minutes after the accident and pleaded guilty.

He said that the defendant had been unable to sleep and had suffered from stress and increased blood pressure as a result of the collision.

‘It has taken a long time to come to court and I think it is a factor in terms of sentence,’ said the lawyer.

Advocate Boothman said that Le Cornu had not driven since the date of the accident and had no intention of driving again. He said she was considering handing her licence back to the parish Constable.

In sentencing, Assistant Magistrate Peter Harris said that he accepted it was a momentary misjudgment. He said that if Le Cornu did want to drive again she would have to retake a test when her driving ban ended.
