‘Bullied’ farm hands jailed for battering co-worker

The Magistrate’s Court heard that the ‘disorientated’ victim woke up to find himself being punched by Kamil Biernacki (20) and Janusz Sebastien Laczynski (19) in staff accommodation at a farm on Route de Vinchelez in St Ouen.

Biernacki and Laczynski claim they carried out the attack as they had been criticised by the victim for not working hard enough.

Legal adviser Advocate Carla Carvalho said that the defendants – who had been drinking – entered the victim’s room on the night of Saturday 15 July and started punching him while he was in bed asleep.

In sentencing, the Magistrate Bridget Shaw said the offence was so serious that a non-custodial sentence could not be justified, although she acknowledged that they were young men living in difficult conditions.

‘It was a place with a bad atmosphere, you worked very long days, endured poor working conditions that fuelled your frustration and the older men were not sympathetic,’ she said.

However, she added: ‘The two of you beat up one man, and you beat him up extensively. Blood was splattered on the wall. There were multiple injuries, particularly around his head and this assault was aggravated by alcohol.’
