The court was told that Andrew James Toland (28), of the Esplanade, ‘was one of those people who thinks that no means yes’ and had said in a question and answer interview that he had heard the woman tell him no on at least seven occasions.The alleged incident happened between Thursday and Friday of last week when Toland was invited to a social occasion at the victim’s flat.
The victim’s daughter had been asleep next door and the prosecution said that she was very distressed when she awoke.Toland reserved his plea to the rape and was remanded in custody until his next court appearance on 8 September, when the case is due to be committed to the Royal Court.
