Five-year restraining order for holding woman by the throat

Jose Paulo Ferreira Mendes, of Don Road, was also sentenced to 140 hours of community service and given a 12-month probation order after pleading guilty to grave and criminal assault.

The assault took place at an address in St Helier on the evening of 29 January after the defendant had been drinking.

During a row Mendes snatched the woman’s mobile phone and she told him to leave her flat.

He responded by taking hold of the woman’s throat with his right hand and then pinning her against a wall.

The Magistrate’s Court heard that the woman was ‘very scared and was struggling to breathe’.

Mendes suddenly stopped the assault but left the property still holding the woman’s phone.

Advocate Martin Elks, defending, said that the incident was at the lower end of the scale for strangulation-type offences.

In sentencing, Relief Magistrate Sarah Fitz said that it was the fourth time Mendes has appeared in court since he arrived in Jersey in 2010 and warned him that if he appears again, he may be liable for a recommendation for deportation.
