Driver jailed after pretending to be brother

Luis Carlos Goncalves Fernandes (31) pleaded guilty to two charges of driving while disqualified, two counts of driving without insurance and two further charges of obstructing police officers.

Fernandes was first stopped in the early hours of 5 March driving a black Honda Civic in Bagatelle Road. He gave his brother’s name to officers and was then allowed to go.

On the second occasion, on 27 March, the same black Honda Civic was spotted travelling quickly through town and officers stopped the vehicle outside Liberation Court, in St Saviour’s Road. Again Fernandes gave his brother’s details but officers became suspicious this time, as he appeared to be nervous.

The Magistrate’s Court heard that as a result of further questioning and after more inquiries, the defendant admitted that he had given false details.

Fernandes had been disqualified from driving for 18 months in 2007 for taking and driving away a vehicle. Although he had, at some point, held a provisional licence Fernandes had not passed a driving test and therefore remained banned from driving.

Advocate Linda Helm, defending, said that it was her client’s instructions that he had only driven the car on the two occasions he was stopped.
