Used offensive language talking on a phone

The defendant, of Mont Millais, was on his phone outside the Havana nightclub in Bath Street about 2.20 am on 9 October when he was heard by a police officer making comments that could have been deemed offensive to a Portuguese person.

The Magistrate’s Court heard that he was also swearing and was challenged about the comments and his language.

Centenier Danny Scaife said that when asked to stop he swore again and was arrested.

Assistant Magistrate Peter Harris said the abusive words were spoken within the hearing of people who were likely to be caused distress.
