States to debate the dual role of the Bailiff

A proposition lodged by St Brelade Deputy Montfort Tadier is calling for the dual role to be scrapped, with a Speaker being elected from within the Assembly.

The role has been questioned on a number of occasions with some suggesting that the Bailiff has too much power. Both the Clothier Report, spearheaded by UK parliamentary commissioner Sir Cecil Clothier in 2000, and the Carswell Review, led by high-ranking UK lawyer Lord Carswell in 2010, recommended that the Bailiff should be replaced in his States role.

Also at Tuesday’s sitting, Members will be asked to abolish the use of exclusivity clauses in some zero-hour contracts. The clauses mean that an employee is unable to accept work from another company, regardless of whether that person has guaranteed hours as part of his or her contract.

The proposition, lodged by St Helier Deputy Sam Mézec, is calling on Social Security Minister Susie Pinel to bring forward law changes within six months.
