Small claims court needed, says lawyer

Advocate Timothy Hanson has raised concerns about the lack of a small claims court in the Island following a bout of suspected food poisoning that caused both him and his elderly mother to become severely ill.

He is considering taking legal action against the retailer that supplied the food, but said that Islanders in a similar situation could face costs in excess of £20,000 if the opposing side mounted a defence of a claim.

After preparing a meal of pre-cooked salmon, salad, beetroot and a baked potato, followed by strawberries, Advocate Hanson and his 84-year-old mother fell ill later the same night and the advocate went on to contact the Health Department and was advised that the onset of symptoms – within a few hours – could indicate that pesticides on the strawberries could be to blame, rather than bacteria.
