Appeal against finance centre progressing

Developers C Le Masurier Ltd – vocal opponents of the scheme – submitted their appeal against building five of the finance centre project following the units’ approval earlier this year.

It is claimed that the plans breach key policies in the Island Plan, which governs building in Jersey.

Now, the Judicial Greffe is in the process of identifying parties involved or those with an interest in the scheme and is due to invite submissions about the plans to be made.

Under the appeals process, an independent planning inspector will then review the submissions before making a non-binding recommendation to the Environment Minister, who has the final say.

It is not yet known whether the appeal will be conducted in public, but the Planning Department has previously said that high-profile or large-scale appeals that carry significant public interest may be held in open sessions.

Smaller appeals would simply involve the planning inspector reviewing documents and evidence before coming to a conclusion.

Building four of the Jersey International Finance Centre, which is being developed by the States-owned Jersey Development Company, began construction earlier this summer.

A scrutiny review of the project is also expected to be finished later this year.

C Le Masurier’s grounds for appeal against building five is based on the claim that the Planning Applications Committee and/or the Environment Minister acted unlawfully, failed to take into account relevant considerations or considered irrelevant points and ultimately reached a decision that was unreasonable.

Ben Ludlam, C Le Masurier Ltd’s director of property, said: ‘Ultimately you need to have the JDC acting as an arms-length property company, which it clearly isn’t doing because planning laws aren’t being followed.

Mr Ludlam added that Environment Minister Steve Luce would have to have very good reasons not to follow the recommendation of the expert planning inspector following the review.
